Is Kalshi legal in California? What Kalshi's terms, California law and the Ninth Circuit say
Kalshi's Member Agreement, read on 27 October 2026, names no US state as a restricted jurisdiction, so it accepts California users. California has not sued Kalshi, but its Attorney General has joined at least seven multistate briefs against it, and on 16 September 2026 the Ninth Circuit held two California tribes are likely to win their claim that Kalshi's sports contracts on tribal lands are illegal gaming.
Kalshi takes users in California. Its Member Agreement, read on 27 October 2026, lists restricted countries in Section VI and names no US state. The state has not sued Kalshi or sent it a cease-and-desist on record, but California law bans sports betting, its Attorney General has joined at least seven multistate briefs against Kalshi, and on 16 September 2026 the Ninth Circuit sided with two California tribes.
Documents read on 27 October 2026: Kalshi's Member Agreement and help centre, two Ninth Circuit opinions, the California Attorney General's release of 12 June 2026, and the Supreme Court docket in case 26-299 with the states' amicus brief. This is not legal advice.
Does Kalshi allow California users?
Yes, by its own documents. Section VI of the Member Agreement bars trading for anyone "domiciled in, organized in, or located in" a listed jurisdiction. The list is countries and sanctioned territories. No US state is on it, and the help centre article on signing up, dated 10 March 2026, asks only that a user "Be 18 years or older" and refers to "international jurisdictions" for restrictions.
The same section carries two clauses that matter if California's position hardens. The member represents that they are not located in a place where trading is barred:
located in any jurisdiction in which trading Event Contracts on the Platform is prohibited under Applicable Law or by Kalshi policy.
And Kalshi keeps the right, "in its sole and absolute discretion, to grant, deny, condition, suspend, or revoke membership or access to the Platform". Kalshi can switch California off, or switch off one contract type, without amending anything.
Is sports betting legal in California?
No. The Ninth Circuit put it in one line on 16 September 2026: "Sports betting is legal in many states", citing Nevada's statutes, "but not in California, see Cal. Penal Code § 337a(a)(6)." The statute's own text on the Legislature's site sat behind a browser check on 27 October 2026, so the wording of section 337a was not verified from the primary page.
California has no state regulator licensing online sportsbooks or online casinos. The California page of the state guide records that, and the 2025 law on sweepstakes casinos.
What has California done about Kalshi?
It has filed briefs, not lawsuits. On 12 June 2026 Attorney General Rob Bonta joined a coalition of 37 attorneys general backing Ohio in the Sixth Circuit. His office called it "the seventh time California has joined nationwide multistate amicus efforts targeting Kalshi and similar prediction market companies." His statement:
Prediction markets cannot use federal loopholes to bypass state consumer protection, sports gaming, and gambling laws.
On 7 October 2026 California signed the brief of "Ohio, 38 Other States, and the District of Columbia" asking the Supreme Court to take New Jersey's case against Kalshi. The signature block lists "Attorney General of California".
No cease-and-desist letter from a California agency, and no state lawsuit against Kalshi, was found on the Attorney General's site or in the court records read for this page.
What did the Ninth Circuit decide about Kalshi and the California tribes?
That the tribes are likely to win. Blue Lake Rancheria and Chicken Ranch Rancheria of Me-Wuk Indians sued Kalshi, KalshiEX and two Robinhood entities in the Northern District of California (No. 3:25-cv-06162). Judge Corley denied a preliminary injunction. On 16 September 2026 the Ninth Circuit reversed that in part. The tribes are likely to succeed in showing that "Kalshi's event contracts on tribal lands violate IGRA and the Tribes' gaming ordinances", the Indian Gaming Regulatory Act being the federal law on gaming on Indian lands.

The court held the contracts are located on Indian lands when a user enters them from there, and that the Commodity Exchange Act's exclusive jurisdiction does not reach them. It also had a view on the marketing:
In this court, Kalshi studiously wraps its product in the language of derivatives. Its advertising is less coy.
The ruling has limits. It covers sports contracts entered from tribal lands, not the rest of California. It did not itself issue an injunction: it remanded so the district court can "reach the remaining Winter factors in the first instance." Whether the district court has ruled since was not verified. The tribes lost their false-advertising claim over the slogan "Sports Betting [Is] Legal in all 50 States on Kalshi."
Where does California sit in the preemption fight?
In the Ninth Circuit, which has twice ruled against Kalshi in 2026.

| Case | Court | Date | Result |
|---|---|---|---|
| KalshiEX v. Assad (Nevada) | 9th Cir. | 28 Aug 2026 | No likely preemption for sports contracts |
| Blue Lake Rancheria v. Kalshi | 9th Cir. | 16 Sep 2026 | Tribes likely to win under IGRA |
| Flaherty v. KalshiEX (New Jersey) | Supreme Court | Petition filed 2 Sep 2026 | Kalshi's response due 9 Nov 2026 |
| California amicus, No. 26-299 | Supreme Court | 7 Oct 2026 | California signed for the states |
| State action against Kalshi | California courts | None found | Not applicable |
In the Nevada case the court wrote: "Kalshi has not shown a likelihood that the CEA preempts state gaming regulations as applied to its sports event contracts." Federal courts in California follow Ninth Circuit precedent. If California's regulators chose to act, Kalshi would be arguing preemption in a circuit that has already rejected it twice at the preliminary stage. What does it mean for a California account?
Kalshi's terms, not California's, decide what happens to an account. The Member Agreement says a membership "may be limited, conditioned, restricted or terminated by Kalshi". On money in and out, item J of the member acknowledgements in Section VI says that within 90 days of an ACH deposit those funds "may only be withdrawn to the external account from which they were debited". The agreement does not say what happens to open positions if a state is switched off.
A Californian on tribal land trading sports contracts is the user the Ninth Circuit ruling describes. Nobody has been prosecuted on the documents read here; the cases name Kalshi and Robinhood, not users.
Prediction-market gains are taxed federally whatever the state says about gambling. See Kalshi and Polymarket taxes. Fees and markets are compared in Polymarket vs Kalshi, and the other states are in Is Kalshi legal in my state?, including Texas, Florida and Nevada.
