Is Kalshi legal in Utah? The state's gambling ban, its lawsuit against Kalshi and the CFTC's suit against Utah

Utah's attorney general sued Kalshi in state court on 20 October 2026, alleging its event contracts are illegal gambling under a state that bans gambling in its constitution. A federal judge ruled for Utah in Kalshi's own case in August 2026, and on 26 October 2026 the CFTC sued Utah to stop it enforcing those laws. No order blocking Kalshi in Utah was found, and Kalshi's terms name no US state.

Is Kalshi legal in Utah? The state says no. Utah's constitution bars the Legislature from authorizing "any game of chance", and on 20 October 2026 the attorney general sued Kalshi in Salt Lake County, alleging its event contracts are illegal gambling. A federal judge ruled for Utah in August

  1. But no court order stopping Kalshi in Utah was found as of 28 October 2026, and on 26 October the CFTC sued Utah to block enforcement.

Update, 29 October 2026: Utah's attorney general has also filed 14 criminal counts naming KalshiEX LLC, with its two co-founders as co-defendants, in a filing dated 28 October 2026. The counts are allegations. See the criminal charges brief.

Court records, statutes and Kalshi's terms were read on 28 October 2026. The state's claims are allegations. This is not legal advice.

Does Kalshi allow Utah users?

Its terms do. Section VI of the Member Agreement lists the jurisdictions where trading is barred, and they are countries and sanctioned territories. Utah is not on the list, and no other US state is. The help centre article dated 10 March 2026 asks only that a user "Be 18 years or older" and says "It is your individual responsibility to ensure that your access and use on the Kalshi Exchange is permissible and lawful for you."

Section VI also lets Kalshi "grant, deny, condition, suspend, or revoke membership" in its "sole and absolute discretion", so it can switch Utah off without changing the agreement.

What does Utah law say about gambling?

Utah bans it twice. The constitution, Article VI, Section 27:

The Legislature shall not authorize any game of chance, lottery or gift enterprise under any pretense or for any purpose.

The criminal statute that used to sit at Utah Code 76-10-1102 is now section 76-9-1402. The 2025 criminal code recodification bill, H.B. 21, renumbered it, and the Legislature's page shows the new section in force since 7 May 2025. An actor commits "participating in gambling" by taking part in gambling, fringe gambling or "online gambling". A first offence is a class B misdemeanor and a repeat is a class A misdemeanor. The definitions in 76-9-1401 count "a proposition bet" as gambling and exclude "a lawful business transaction".

The statute reaches players, not only operators. No Utah user has been charged on any document read; the cases name companies. The Utah page of the state guide has the rest of Utah's rules.

What is Utah's lawsuit against Kalshi?

A civil suit in state court, Brown v. Kalshi Inc., No. 260908356, filed on 20 October 2026 in the Third Judicial District Court in Salt Lake County. It names five Kalshi companies and two Susquehanna companies. The attorney general's release:

Kalshi runs an online casino in Utah and calls it a prediction market. That violates Utah law.

Gambling is illegal in Utah. Kalshi advertised its sports and election bets as “legal in all 50 states” anyway. Utah is suing, alleging Kalshi kept taking bets from Utahns after a federal judge rejected its argument that Utah law doesn’t apply.

The complaint cites a Kalshi filing of 25 February 2026 counting 55,819 accounts with a Utah address, 32,940 of them fully signed up. It estimates Kalshi took $30,591,600 to $61,183,200 in fees from Utah accounts, an estimate the state builds by assuming that share, 1.11 percent of open positions, held constant over Kalshi's lifetime, at $0.01 to $0.02 a wager. It asks for injunctions, disgorgement and a third-party geolocation provider "which must be approved by the Court". The filing is covered in detail in the Utah lawsuit brief.

What did the federal court decide in Kalshi's case against Utah?

That Utah's law stands, for now. Kalshi sued Governor Spencer Cox, Attorney General Derek Brown and three other officials in the District of Utah on 23 February 2026 (No. 2:26-cv-00151), per the court docket. The attorney general's release says Judge Robert Shelby granted summary judgment to Utah in August, "holding that the federal law does not override Utah's gambling laws." The states' Supreme Court brief and Utah's complaint both cite the ruling as dated 4 August 2026.

Timeline: Kalshi sues Utah officials on 23 February 2026, Utah wins summary judgment on 4 August, the Tenth Circuit denies an injunction pending appeal on 8 September, Utah sues Kalshi on 20 October and the CFTC sues Utah on 26 October 2026, and Utah files 14 criminal counts naming Kalshi on 28 October 2026.

Kalshi's appeal, No. 26-4100, was docketed in the Tenth Circuit on 5 August 2026. The release says the Tenth Circuit on 8 September "denied Kalshi's request to block enforcement of Utah's laws pending appeal." That order was not read from the court's record. The appeal is pending.

Why is the CFTC suing Utah?

To stop Utah's case. The United States and the CFTC sued the State of Utah and Attorney General Derek Brown in the District of Utah on 26 October 2026, case No. 2:26-cv-01055, and announced it on 27 October. The single count, under the Supremacy Clause, argues the Commodity Exchange Act preempts Utah's gambling statutes as applied to contracts on CFTC-regulated exchanges. It asks for a declaration and an injunction barring Utah from enforcing those laws against such transactions.

Utah seeks to shut down prediction markets across a wide variety of markets.

CFTC Chairman Michael S. Selig, press release 9315-26, 27 October 2026

The release says the CFTC has started proceedings against nine other states. The suit and its relief are in the CFTC lawsuit brief, and the split between the federal circuits is in Is Kalshi gambling?.

Utah's attorney general signed the 7 October 2026 brief of Ohio, 38 other states and DC asking the Supreme Court to hear New Jersey's case against Kalshi, No. 26-299. That brief states: "Utah prohibits sports gambling".

What does it mean for a Utah account?

Nothing has changed by order yet: neither new case had produced an order as of 28 October 2026, on the records found. A state injunction would block the covered contracts through geolocation; a federal one would stop Utah enforcing its laws against them while it stands. Kalshi's agreement does not say what happens to open positions in a state it switches off.
