Is Kalshi legal in my state?

Section VI of Kalshi's Member Agreement, read on 27 October 2026, names no US state as a restricted jurisdiction. At least seventeen states have sent Kalshi a cease-and-desist letter, sued it or charged it, and courts in Nevada, Michigan and Washington have ordered it to stop offering sports contracts there.

Is Kalshi legal in your state? Kalshi's own terms do not exclude any US state. Section VI of its Member Agreement, read on 27 October 2026, lists restricted countries only. But at least 17 states had sent Kalshi a cease-and-desist letter, sued it or charged it by that date, and courts in Nevada, Michigan and Washington have ordered it to stop offering sports contracts there.

The table gives both layers, Kalshi's terms and your state's documents, for all 50 states and DC. This is not legal advice.

What does Kalshi's Member Agreement say about US states?

Nothing state by state. Section VI, headed "Representations and Warranties", says "You are prohibited from trading Event Contracts on the Platform if You are domiciled in" one of the listed jurisdictions. The list starts with Afghanistan, Algeria and Angola, includes Australia and Canada, and ends with Zimbabwe and a catch-all for jurisdictions under US sanctions. No US state or territory is on it. The only named state anywhere in the agreement is New York, as the governing law.

The section adds a general bar on trading where it "is prohibited under Applicable Law or by Kalshi policy", and says "the restrictions set forth in this Section apply solely to the trading of Event Contracts". Kalshi's help centre puts the legal question on the user:

It is your individual responsibility to ensure that your access and use on the Kalshi Exchange is permissible and lawful for you.

The same article sets the minimum age at 18. Missouri's attorney general says that is the problem in a 21-and-over sports betting state: Kalshi's agreement admits anyone of "the age of majority in [their] state of residence".

Which states have taken action against Kalshi?

At least seventeen, on documents from the state or a court: Arizona, Connecticut, Illinois, Maryland, Massachusetts, Michigan, Missouri, Nevada, New Jersey, New Mexico, New York, Ohio, Rhode Island, Tennessee, Utah, Washington and Wisconsin. Thirty-seven attorneys general also joined an amicus brief on 12 June 2026 backing Ohio's right to enforce its gaming law against Kalshi in the Sixth Circuit, per the California attorney general. On 7 October 2026, 38 states and DC joined Ohio's brief asking the Supreme Court to hear New Jersey's case, No. 26-299. Texas, Florida and Georgia signed neither brief.

My office and a group of AGs are supporting a lawsuit against @Kalshi for illegally offering sports betting that violates states' gambling laws. Kalshi’s sports event contracts are gambling by another name, and they should play by the same rules as every other gambling platform.

View on XNew York's Attorney General stating the position the multistate briefs in this section take: that Kalshi's sports contracts are gambling under state law.

"Amicus" means the state's attorney general joined that 12 June brief. "None found" means this pass found no state document, not that the state has no view.

Where has a court ordered Kalshi to stop?

In three states on documents read for this page, and a fourth whose order's effect was not verified.

Status table: preliminary orders against Kalshi in Nevada, Michigan with a $500,000 daily fine, and Washington; a Massachusetts injunction whose current effect is not verified.

Kalshi Banned From Operating in Nevada for Now by JudgeVideo by Bloomberg Podcasts on YouTube. Watch on YouTubeA Bloomberg report from March 2026 on the Nevada judge's temporary order barring Kalshi's contracts, the first state court order this section lists.

The order requires Kalshi to stop offering, accepting, or facilitating wagers on sports, elections, politics, entertainment, culture, tech and science, or mentions in Washington.

Washington Attorney General, news release, 13 August 2026, retrieved 27 October 2026

These are preliminary orders. The states' claims have not been tried.

What do the federal courts say?

They have split, and the Supreme Court may decide. The Third Circuit sided with Kalshi in New Jersey on 6 April 2026. The Ninth Circuit ruled for Nevada on 28 August 2026, and the Sixth Circuit ruled for Ohio and Tennessee on 25 September 2026. New Jersey's petition, No. 26-299, shows Kalshi's response due 9 November 2026. The full reasoning is in Is Kalshi gambling?.

BREAKING: A federal judge today ruled that Kalshi is subject to Ohio sports betting law. Kalshi argued the federal Commodity Exchange Act preempts enforcement of Ohio law. Nope. These “prediction markets” have exploded and look an awful a lot like gambling. Big win for Ohio!

View on XOhio's Attorney General on the district court ruling in Ohio's favour, the case the Sixth Circuit later decided for Ohio on 25 September 2026.

What happens to my account if my state acts?

Kalshi's agreement does not say. Its Section VI restrictions apply only to event contracts, so the agreement itself does not close an account by state. The court orders above target contracts, not balances. Connecticut's December 2025 order told Kalshi to let residents withdraw the funds they held. Fees are compared in Polymarket vs Kalshi, and taxes in Kalshi and Polymarket taxes.

State guides

Eight states have their own page, with the statute, every action and the federal case: California, Texas, Florida, New York, Nevada, Georgia, Washington and Utah.

How this table was built

Kalshi's Member Agreement and help centre were read on 27 October 2026. State actions count only where the state's own site or a court record carried the document. Actions known only from news reports are marked "not verified": Arkansas's attorney general opinion, Montana's letters and Louisiana's case among them. The Iowa ruling is known only from its citation in Missouri's letter and the states' 7 October brief.

Quick answers

Kalshi's terms restrict no US state as of 27 October 2026. At least 17 states say its sports contracts break their law, and courts in Nevada, Michigan and Washington have ordered it to stop there. See the table above.

Which states have banned Kalshi?

No final judgment in a state's own case against Kalshi was found. Preliminary orders cover Nevada, Michigan and Washington, and Minnesota's felony law took effect on 1 August 2026, with enforcement not verified.

None of the three is named in Kalshi's terms, and no enforcement action by those states was found. California joined the 12 June 2026 amicus brief. Details are in the California, Texas and Florida guides.

How old do you have to be to use Kalshi?

18, per its help centre. Missouri's attorney general wrote on 16 September 2026 that Kalshi "has no authority to allow sports wagering by persons in Missouri under the age of 21".
