Dutch regulator fines Instantcasino operator €37.25m

On 22 October 2026 the Kansspelautoriteit announced a €37.25 million fine against EOD Code SRL, the company behind Instantcasino and 11 other sites, for offering gambling to Dutch players without a licence. The decision treats crypto and anonymous payment methods as an aggravating factor and can still be challenged by objection.

The Dutch Gambling Authority, the Kansspelautoriteit (Ksa), announced on 22 October 2026 a fine of €37.25 million against EOD Code SRL, the company behind Instantcasino and 11 other casino sites, for offering gambling to players in the Netherlands without a licence. The Ksa calls the €37.25 million fine the largest it has imposed for illegal gambling so far. Crypto deposits were among the aggravating factors in the calculation, though the final amount was set by a legal 10 percent cap.

What the document says

The press release names twelve sites: Instantcasino, Skyhills, Slotmonster, Betiro, Betblast, Fastslots, Goldenpanda, Sambaslots, Winningz, Incognitocasino, Foxygold and Luckypays.io. Ksa staff were able to play on them from the Netherlands with no measures blocking Dutch players and no visible age check. On payments it says:

Ook hadden bezoekers de mogelijkheid om te betalen met cryptocurrency en anonieme betaalmethoden.

In English: visitors could also pay with cryptocurrency and anonymous payment methods. The press release adds that this makes money laundering easier.

The fine decision itself is dated 6 October 2026. It estimates the gross gaming revenue from Dutch players in 2025 at €108,374,000. The Ksa set a basic fine of 100 percent of that figure and raised it by 170 percentage points to 270 percent, about €292.6 million. Crypto deposits added 10 of those 170 points, under the heading of payment methods, which the decision calls "ongeoorloofde betaalmethodes", unauthorised payment methods. The largest increases, 50 points each, were for the missing age verification and for special circumstances such as unfair terms. The law caps the fine at 10 percent of estimated worldwide gross gaming revenue. With worldwide revenue estimated at €372,989,000, the cap is €37,298,900, and the Ksa rounded down to €37,250,000.

The decision records that EOD Code's own website says the company is registered and regulated in Costa Rica and that the courts of Curacao have jurisdiction. The decision reports these as statements on the website and does not say whether they are accurate. It confirms that EOD Code holds no Dutch licence.

What it changes for users

The fine is against the company, not against players. Under Dutch law only operators with a Ksa licence may offer online gambling to people in the Netherlands, and none of the twelve sites has one.

Timeline: an order subject to a penalty on 26 August 2025, a decision to collect penalty payments on 11 December 2025, the €37,250,000 fine decision on 6 October 2026, and its announcement on 22 October 2026.

The decision is not final. The Ksa sanctions page says an objection can be filed against the 6 October fine decision. An earlier order subject to a penalty of 26 August 2025 and an 11 December 2025 decision to collect penalty payments were not challenged and are final, according to the same page.

The press release also says the Ksa works with payment providers, hosting companies, banks and large tech companies to cut off illegal offers. It does not say whether any of the twelve sites has stopped taking Dutch players.

Background

EOD Code is not the first crypto casino company the Ksa has fined this year. A 9 June 2026 fine decision against Chestoption is the source the register uses for the operating company behind Vave, as set out in who owns the crypto casinos. None of the twelve EOD Code sites is on the register. For what identity checks each regulator requires, see gambling KYC by regulator.

Quick answers

How big is the EOD Code fine?

€37,250,000, set in a decision dated 6 October 2026 and announced on 22 October. The Ksa says €37.25 million is the largest fine it has imposed for illegal gambling.

Why did crypto matter?

The decision counted crypto deposits as an aggravating factor worth 10 points of the increase, and the press release says such payments make money laundering easier. The final amount was still set by the 10 percent turnover cap.

Can EOD Code appeal?

Yes. The Ksa sanctions page says an objection can be filed against the fine decision, so it is not yet final.
