Bitstamp review: licences, terms and gambling clause
Can you deposit to a casino from Bitstamp?
Bitstamp's terms restrict gambling without banning it outright, in Terms of Use, suspension and termination grounds; a deposit to a casino not licensed where you live can breach them. Its terms let it freeze or suspend an account. 1 registration is confirmed in an issuing register. 3 points are not verified. No primary-source incident is recorded.

Disclosure: CryptoGuardz has no commercial relationship with Bitstamp, earns nothing if you open an account there, and has not contacted the company or given it notice of this entry. Every statement below is either a verbatim quote from a document Bitstamp publishes or a statement about a public register, and both carry the date they were read. Corrections go to the corrections page.
1. What this means for you
Consequences first, in the conditional, each one produced by a clause in a document Bitstamp publishes itself. Every line links to that clause, quoted in full and dated.
- Your account can be suspended or closed for any reason Bitstamp gives The freeze clause itself requires notice, but a separate ground lets the exchange suspend or terminate an account for any reason. Both are quoted below.
- You are probably not covered by the authorisation you can see if you are outside the European Economic Area The confirmed authorisation is held by Bitstamp Europe S.A., and the entity that contracts with a user elsewhere is a different company.
- You may breach the terms if the casino you fund is unlicensed where you live Bitstamp's clause covers unlawful, unregulated or illegal gambling rather than gambling as such. It is quoted in section 10.
2. What this entry records, and what it does not
This register publishes no number for an exchange. The payout score on the casino register has five defined components and a published arithmetic; no equivalent instrument exists here, and inventing one to fill the space would be a measurement nobody made. What follows instead is a field-by-field account of what was read, where it was read and when.

3. What we could not verify
Every entry carries this section. The gaps are published because a reader deserves the limits of the check as well as its results.
- Which Bitstamp entity serves a given user. The terms say to check the account profile.
- Any proof of reserves. The expected page returned not found.
- The custodian terms the Terms of Use incorporate by link. They were not read for this entry.
4. Who you are contracting with
The counterparty named in the binding document, not the brand on the website. This is the company a claim would be brought against and whose insolvency estate a user would be a creditor of.

The Terms of Use, last updated 30 May 2025, are "provided by Bitstamp Ltd". The legal notice on the same page gives its registered address as 5 New Street Square, London, and registration number 8157033.
The same notice says crypto-asset services are provided by different Bitstamp entities "depending on client residency": Bitstamp Europe S.A. in Luxembourg, Bitstamp UK Ltd., Bitstamp Ltd., Bitstamp Global Ltd. in the British Virgin Islands, and Bitstamp USA, Inc. It adds that a user finds out which one serves them in their account profile.
The Terms of Use shall be governed and construed in accordance with the law of England and Wales. The parties hereto agree to irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.bitstamp.net
5. Registrations, claimed and confirmed
1 of the registrations Bitstamp claims was found in the issuing authority's own public register. A confirmed registration covers the entity named on it and nothing else. The confirmed authorisation covers Bitstamp Europe S.A. The terms read here are those of Bitstamp Ltd in London.
| Authority | Kind | Confirmed | What it covers |

| Commission de Surveillance du Secteur Financier (CSSF), Luxembourg, crypto-asset service provider authorisation under Regulation (EU) 2023/1114 (MiCA) | authorisation | yes | Confirmed. The official ESMA interim MiCA register of authorised crypto-asset service providers, downloaded 28 September 2026, carries the row: competent authority Commission de Surveillance du Secteur Financier (CSSF), Luxembourg, entity Bitstamp Europe S.A., LEI 549300XIBGTJ0PLIEO72, authorisation notification date 15/05/2025, no end date. Services authorised: custody and administration; operation of a trading platform for crypto-assets; exchange of crypto-assets for funds and for other crypto-assets; execution of orders; reception and transmission of orders; transfer services. It covers Bitstamp Europe S.A. only. |
| European Securities and Markets Authority (MiCA register of non-compliant entities) | adverse listing | not listed | Negative check. The official ESMA register of non-compliant entities providing crypto-asset services was downloaded on 28 September 2026 and searched. The string Bitstamp does not appear in it. |
6. Proof of reserves
No Bitstamp-hosted proof of reserves page could be loaded. bitstamp.net/proof-of-reserves/ returned a page-not-found notice. No other proof of reserves location was found. Recorded as no data.
Nothing is recorded here as a result. The field is No data rather than no, because a page that would not load is not the same as a disclosure that does not exist, and this register does not publish the two as though they were.
7. Custody, segregation and insolvency
What the binding document says about where your coins sit and what happens to them if the exchange fails, quoted rather than characterised.
Your Virtual Assets and Digital Assets will be held on your behalf in a wallet in the name of Bitstamp together with other Members’ Virtual Assets and/or Digital Assets.bitstamp.net
Notwithstanding the direct custodial relationship between the custodian(s) and you, if for any reason Bitstamp is held or declared by any court or regulatory authority of competent jurisdiction to have any legal or beneficial interest in your Virtual Assets or other Digital Assets, Bitstamp will hold on trust for you all such right title and interest which Bitstamp is so held or declared to havebitstamp.net
The intention behind the trust arrangements is that your fiat currency should be protected in the event of our insolvency and can be returned to you.bitstamp.net
8. Freezing your account
2 clauses, quoted in the order they appear in the document. Read the last one first: it is the ground that swallows the others.

Additionally, we may, in appropriate circumstances and at our discretion, suspend or terminate Accounts of Members for any reason, including without limitation:bitstamp.net
9. Suspending withdrawals
Not recorded. See section 2 for why.
10. Sending funds to a casino from Bitstamp
Bitstamp's terms restrict gambling only where it is unlawful, unregulated or illegal. Whether a deposit to a given casino breaches them depends on that casino's licence and on where you are.
Usage of the Service to perform illegal activities such as money laundering, illegal gambling operations, financing terrorism, or other criminal activities;bitstamp.net
Listed as a ground on which Bitstamp may suspend or terminate an account. It is limited to "illegal gambling operations". Lawful gambling is not addressed.

12. Amendment, liquidation, arbitration and governing law
The clauses that decide what the contract can become, what can be done to an open position, and where a dispute would be heard.
Bitstamp reserves the right to change, add or remove parts of these Terms at any time and at its sole discretion. You will be notified of any changes in advance through your Account.bitstamp.net
13. Public record
No incident is recorded for Bitstamp. That is not a clean bill of health. It means no primary source, meaning a regulator action, a court filing or a company post-mortem, was retrieved within this collection. Absence of a record here is the absence of a search result.
14. Who should avoid Bitstamp
Anyone outside the European Economic Area who is relying on the authorisation they can see. The confirmed authorisation is held by Bitstamp Europe S.A. and covers that company's clients. A user elsewhere is contracting with a different entity under different terms.
