Binance review: licences, terms and gambling clause
Can you deposit to a casino from Binance?
Binance's terms, read 2026-09-28, name no gambling rule. That is not a permission: the general ban on unlawful use still applies. Its terms let it freeze or suspend an account without prior notice. No registration is confirmed in an issuing register. 4 points are not verified. 1 primary-source incident is recorded. KYC rules: no data in this entry.
Documents last checked Reviewed by CryptoGuardz Register Desk, editorial desk
Disclosure: CryptoGuardz has no commercial relationship with Binance, earns nothing if you open an account there, and has not contacted the company or given it notice of this entry. Every statement below is either a verbatim quote from a document Binance publishes or a statement about a public register, and both carry the date they were read. Corrections go to the corrections page.
1. What this means for you
Consequences first, in the conditional, each one produced by a clause in a document Binance publishes itself. Every line links to that clause, quoted in full and dated.
- Your account can be frozen without notice if Binance decides it should be The suspension clause is discretionary and its list of grounds closes with a catch-all that swallows the list. The clause is quoted in full below.
- Your withdrawal can be suspended if Binance decides an incident on the platform requires it The withdrawal clause sets no maximum duration and no external test for when an incident is resolved.
- You have no authority to complain to if something goes wrong, because no registration could be confirmed No authorisation claimed by Binance was found in an issuing authority's own public register.
- You cannot rely on the proof of reserves as an audit, because nobody outside Binance signed it No accountant, auditor or attestation firm is named, no engagement standard is referenced, and nothing in the exercise addresses what the exchange owes.
- You cannot tell from the terms what Binance does about casino deposits The documents read contain no clause on gambling. The general prohibition on unlawful activity still applies.
2. What this entry records, and what it does not
This register publishes no number for an exchange. The payout score on the casino register has five defined components and a published arithmetic; no equivalent instrument exists here, and inventing one to fill the space would be a measurement nobody made. What follows instead is a field-by-field account of what was read, where it was read and when.

3. What we could not verify
Every entry carries this section. The gaps are published because a reader deserves the limits of the check as well as its results.
- The FSRA licences claimed for the three ADGM entities. The FSRA public register was not loaded.
- The proof of reserves as-of date, ratio and Merkle root. The public page shows none of them without a login.
- Which Binance entity contracts with a user in a country that has Local Terms. The terms say Local Terms supplement the agreement where they apply; none were read for this entry.
- The Department of Justice case page, which was read through a search index rather than loaded directly.
4. Who you are contracting with
The counterparty named in the binding document, not the brand on the website. This is the company a claim would be brought against and whose insolvency estate a user would be a creditor of.

The Binance Terms of Use, effective 21 July 2026, are published as a PDF linked from binance.com/en/terms. They open: "These Terms constitute a legally binding agreement between you ("you" or "your") and the Binance entities identified below (each an "ADGM Binance Entity", collectively, "ADGM Binance Entities" "Binance", "we", "our" or "us"):" Three companies follow, each with an ADGM registration number and the address Addax Tower, Al Reem Island, Abu Dhabi.
The three split the work. Nest Exchange Limited operates the trading venue, Nest Clearing and Custody Limited holds the assets as custodian, and Nest Trading Limited is the broker-dealer. The terms add: "Each ADGM Binance Entity is a separate legal entity. You will have separate contractual obligations to and from each ADGM Binance Entity as described in the Agreement, supported by a single unified account structure for operational purposes."
This is the only exchange in the cohort whose binding document names every counterparty with a company number and a place of registration in the opening paragraph. The binance.com page that links the PDF was only retrievable through a rendering service; the PDF itself downloads directly from Binance's own static host.
These Terms (including the arbitration agreement at Clause 37 (Agreement to Arbitrate) above) shall be exclusively governed by, and construed in accordance with, the law of the ADGM.bin.bnbstatic.com
5. Registrations, claimed and confirmed
No registration Binance claims could be found in an issuing authority's own public register. That is an absence of confirmation, not evidence that a registration is invalid. Binance claims its licences inside the binding document, which is more than most of the cohort does. The claims are to an Abu Dhabi regulator, not an EU one, and the ESMA MiCA register holds no Binance entity.
| Authority | Kind | Confirmed | What it covers |
|---|---|---|---|
| Financial Services Regulatory Authority (FSRA) of the Abu Dhabi Global Market | authorisation | no | Claimed in the terms themselves: Nest Exchange Limited as operator of a Recognised Investment Exchange and Multilateral Trading Facility, Nest Clearing and Custody Limited as operator of a Recognised Clearing House with a custody stipulation, and Nest Trading Limited as an Authorised Person holding Financial Services Permissions. Not confirmed: the FSRA public register was not loaded for this entry, so no register URL is recorded. Recorded as claimed and unconfirmed. |
| European Securities and Markets Authority (MiCA register of authorised crypto-asset service providers) | authorisation | no | Not applicable. This row records a negative check: the official ESMA interim MiCA register of authorised crypto-asset service providers was downloaded on 28 September 2026 (latest record update 22 September 2026) and searched. the string Binance and the string Nest do not appear anywhere in it. Binance holds no EU CASP authorisation that this register could find. |
| European Securities and Markets Authority (MiCA register of non-compliant entities) | adverse listing | not listed | Negative check. The official ESMA register of non-compliant entities providing crypto-asset services was downloaded on 28 September 2026 and searched. The string Binance does not appear in it. |
6. Proof of reserves
Binance publishes a proof of reserves and signs it itself. No accountant, auditor or attestation firm is named, no engagement standard is referenced, and what is published is a cryptographic snapshot the exchange produces about itself. It says nothing about what the exchange owes.
| Signer | Binance itself. No independent accountant, auditor or attestation firm is named on the proof of reserves page. The method is a zk-SNARK proof over a Merkle tree of user balances, which a logged-in user checks against their own record. |
|---|---|
| Standard | None stated. No assurance or attestation standard is referenced. |
| As of | No dataNo as-of date could be read from the page at retrieval. |
| Covers liabilities | noNothing in the exercise addresses borrowings, loan obligations, off-chain claims, or whether the set of user balances in the tree is complete. |
| Page | binance.comretrieved 2026-09-28 |
When we say Proof of Reserves, we are specifically referring to those assets that we hold in custody for users.binance.com
The public page describes the method and states that "Binance holds all user assets 1:1, including reserves" and that "Binance has zero debt in our capital structure". Neither statement is attested on the page by anyone outside Binance.
No snapshot date, reserve ratio or Merkle root is shown on the public page. The page directs a user to log in to see the verification dates for their own account, so the as-of date is recorded as no data.
7. Custody, segregation and insolvency
What the binding document says about where your coins sit and what happens to them if the exchange fails, quoted rather than characterised.
Ledger Segregation: NCCL segregates in the Internal Ledger it maintains its own Digital Assets from Digital Assets held for its clients (for the avoidance of doubt, the term "client" does not include NCCL, but NCCL is a trust beneficiary in respect of the assets in omnibus network addresses held on trust) by maintaining in its own Internal Ledger, separate records of: (i) the amount of Digital Assets held by it which are its own Digital Assets and positions; and (ii) the amount of Digital Assets and positions held by NCCL for each of its clients, including you.bin.bnbstatic.com
Protection on Insolvency: Your interest in assets held on trust by NCCL for you and the other trust beneficiaries under the Agreement is not the property of NCCL and benefit from applicable protections under ADGM Rules in the event of the insolvency of NCCL.bin.bnbstatic.com
8. Freezing your account
2 clauses, quoted in the order they appear in the document. Read the last one first: it is the ground that swallows the others.
Our Right. We may at any time modify or discontinue, temporarily or permanently, any portion or feature of the Binance Services. In particular, we may: (1) refuse to complete or block, cancel, or, where permitted by ADGM Rules, reverse any Transaction you have authorised; (2) terminate, suspend, or restrict your access to any or all of the Binance Services; (3) terminate, suspend, close, hold or restrict your access to any or all of your Binance Account(s); (4) refuse to transmit information or Instructions to third parties (including but not limited to third-party wallet operators); and/or (5) take whatever action we consider necessary, in each case with immediate effect and for any reasonbin.bnbstatic.com
suspend or restrict your access to your Binance Account and/or any Binance Services, with immediate effect and without prior notice;bin.bnbstatic.com
Clause 13.3.1(a): the consequence of failing to provide information Binance requests.
9. Suspending withdrawals
Binance may not process a withdrawal request if, in our reasonable opinion, we consider that ADGM Rules, other legal restrictions, or this Agreement prevent the execution of the relevant withdrawal. Binance may also suspend withdrawals at such time deemed appropriate by Binance to resolve any incidents on the Binance Platform. Once such incidents have been resolved, Binance will resume withdrawals.bin.bnbstatic.com
10. Sending funds to a casino from Binance
Binance's terms say nothing about gambling. The documents searched are listed below.
Neither the Terms of Use nor the Prohibited Use Policy (last updated 5 January 2026) contains the words gambling, casino, betting or lottery. The Prohibited Use Policy prohibits activity that contravenes laws and regulations in general terms. A transfer to a casino is therefore not addressed by name in either document Binance publishes.
11. Which networks Binance withdraws USDT on
18 USDT networks listed with withdrawals enabled on 2026-09-28, including Ethereum, Tron, BNB Smart Chain, Solana, Polygon, Arbitrum, Optimism, Avalanche, TON.
Read from the public network list Binance's own website calls, filtered to USDT networks with withdrawEnable true at retrieval. Asset Hub Polkadot was listed with withdrawals disabled and is left out. Source. Which DEXes operate on each of those chains is in the DEX register.
12. Amendment, liquidation, arbitration and governing law
The clauses that decide what the contract can become, what can be done to an open position, and where a dispute would be heard.
How and when we can make amendments. We can make changes to these Terms and any terms and conditions incorporated by reference (other than the Rulebooks), such as any Product Terms, at any time and your continued use of the Binance Services constitutes your consent to such changes.bin.bnbstatic.com
You and Binance agree that, subject to the immediately preceding Clauses 36.2 and 36.3 above (Notice of Claim - Negotiation, then Arbitration), any Claim shall be exclusively and finally resolved by mandatory final and binding individual (not class) arbitration administered by the International Chamber of Commerce (the "ICC") in accordance with the ICC Rules of Arbitration in force at the time of filing of the Claim (the "ICC Rules"). The ICC Rules are deemed incorporated by reference into this Clause 37.1.bin.bnbstatic.com
13. Public record
Matters of public record, taken from primary sources and stated with them. They are not scored, because a historical event is not a measurement of how the exchange behaves today, and leaving them out while citing the sources would be worse.
The Department of Justice announced that Binance Holdings Limited pleaded guilty to conspiracy to violate the Bank Secrecy Act and to fail to register as a money transmitting business, failure to register as a money transmitting business, and violating the International Emergency Economic Powers Act. Its founder and chief executive, Changpeng Zhao, pleaded guilty to causing Binance to fail to implement an effective anti-money laundering program. The Department states that Binance "agreed to pay $4.3 billion in penalties and will undertake compliance enhancement and remediation and retain an independent monitor."
14. Who should avoid Binance
Anyone who needs an authority to complain to. No registration Binance claims could be confirmed in an issuing register, so there is no supervisory body this register can point a user at when something goes wrong.
