eToro review: licences, terms and gambling clause
Can you deposit to a casino from eToro?
eToro's gambling clause: not verified, because its binding document could not be read. Its terms let it freeze or suspend an account. 2 registrations are confirmed in an issuing register. 8 points are not verified. 1 primary-source incident is recorded. KYC rules: no data in this entry.

Disclosure: CryptoGuardz has no commercial relationship with eToro, earns nothing if you open an account there, and has not contacted the company or given it notice of this entry. Every statement below is either a verbatim quote from a document eToro publishes or a statement about a public register, and both carry the date they were read. Corrections go to the corrections page.
1. What this means for you
Consequences first, in the conditional, each one produced by a clause in a document eToro publishes itself. Every line links to that clause, quoted in full and dated.
- Your account can be suspended or closed for any reason eToro gives The freeze clause itself requires notice, but a separate ground lets the exchange suspend or terminate an account for any reason. Both are quoted below.
- Your withdrawal can be suspended if eToro decides an incident on the platform requires it The withdrawal clause sets no maximum duration and no external test for when an incident is resolved.
- You are probably not covered by the authorisation you can see if you are outside the European Economic Area The confirmed authorisation is held by eToro (Europe) Ltd, and the entity that contracts with a user elsewhere is a different company.
2. What this entry records, and what it does not
This register publishes no number for an exchange. The payout score on the casino register has five defined components and a published arithmetic; no equivalent instrument exists here, and inventing one to fill the space would be a measurement nobody made. What follows instead is a field-by-field account of what was read, where it was read and when.

| Withdrawal test | Not measuredNo first-party deposit or withdrawal has been run against this exchange. It would require funding an account, which this register has not done. Until it has, nothing here is a measurement of how fast the exchange pays. |
| On-chain reserve verification | Not measuredNo independent reconstruction of the Merkle tree or of the exchange's wallet holdings has been attempted. |
3. What we could not verify
Every entry carries this section. The gaps are published because a reader deserves the limits of the check as well as its results.
- Schedule D (Trading Cryptoassets) of the EU terms, including its clause 12 on custody. The terms were retrieved as text of 134,695 characters that ends inside Schedule A, so Schedules B to F were not read. Segregation and insolvency treatment of cryptoassets are therefore not recorded.
- Whether the EU terms contain a gambling clause. None of gambling, lottery, casino, betting or wager appears in the retrieved text; "gaming" appears only as "gaming the system" in clause 28.1(d). The schedules were not read.
- The CySEC investment firm licence 109/10. cysec.gov.cy entity pages are disallowed by robots.txt to the retrieval tool.
- The FCA, ASIC, FSAS and ADGM FSRA licences claimed for other eToro entities. The FCA register returned a JavaScript error page on two attempts; the others were not searched.
- The cryptoassets and networks supported for withdrawal from the eToro crypto wallet. The help centre article returned a JavaScript error page and the wallet product page names no networks.
- Company number HE 200585 against the Cyprus companies registry.
- The outcome of ASIC's 2023 Federal Court action against eToro AUS Capital over its CFD target market determination (ASIC media release 23-204MR). It concerns CFDs, not crypto, and its outcome was not retrieved, so it is not recorded as an incident.
- Any proof of reserves.
4. Who you are contracting with
The counterparty named in the binding document, not the brand on the website. This is the company a claim would be brought against and whose insolvency estate a user would be a creditor of.

eToro runs a separate contracting entity per region. Its terms page lists eToro (Europe) Ltd. (CySEC, licence 109/10), eToro (UK) Ltd. (FCA, FRN 583263), eToro AUS Capital Limited (ASIC, AFSL 491139), eToro (Seychelles) Ltd. (FSAS, licence SD076), eToro (ME) Limited (ADGM FSRA, Financial Services Permission No. 220073) and eToro (Singapore) Ltd., each with its own Terms and Conditions. The page lists no US entity.
The document read is the eToro (Europe) Limited Terms and Conditions dated August 12th, 2026. Clause 1.1 states that the terms "form the agreement between you and eToro (Europe) Limited". The company number HE 200585 and the address Neocleous Tower, 199 Archbishop Makarios III Avenue, 9th Floor, Limassol 3030, Cyprus are stated in the terms. The company number was not checked against the Cyprus companies registry, so it is marked unverified.
Every clause below binds a client of eToro (Europe) Limited only. The UK, Australian, Seychelles, Middle East and Singapore terms were not read.

5. Registrations, claimed and confirmed
2 of the registrations eToro claims was found in the issuing authority's own public register. A confirmed registration covers the entity named on it and nothing else. Two authorisations were confirmed in a regulator's own list: the MiCA CASP authorisation of eToro (Europe) Ltd, the counterparty in the terms read here, and the NYDFS licences of eToro NY LLC. The other five licences are recorded as claimed by eToro and not confirmed.
| Authority | Kind | Confirmed | What it covers |
|---|---|---|---|
| Cyprus Securities and Exchange Commission (CySEC), crypto-asset service provider authorisation under Regulation (EU) 2023/1114 (MiCA) | authorisation | yes | Confirmed. The official ESMA interim MiCA register of authorised crypto-asset service providers, retrieved 8 October 2026, carries the row: competent authority Cyprus Securities and Exchange Commission (CySEC), home member state CY, entity eToro (Europe) Ltd, LEI 213800GIFQMSV7HROS23, commercial name e Toro, website www.etoro.com, authorisation notification date 16/01/2025, no end date, record last updated 10/09/2025. Services authorised: custody and administration; exchange of crypto-assets for funds and for other crypto-assets; execution of orders; reception and transmission of orders; advice; portfolio management; transfer services. Operation of a trading platform is not among them. Passported to 30 EEA states. It covers eToro (Europe) Ltd only. |
| Cyprus Securities and Exchange Commission (CySEC), Cyprus investment firm licence | authorisation | no | Clause 1.3 states that eToro (Europe) Limited "is authorised and regulated by the Cyprus Securities Exchange Commission" with reference number 109/10. This is an investment firm licence for securities and derivatives business. Not confirmed: the CySEC entity pages are disallowed to this register's retrieval tool by the site's robots.txt. |
| New York State Department of Financial Services (NYDFS), virtual currency licence and money transmitter licence | authorisation | yes | Confirmed. The NYDFS page listing regulated virtual currency entities, read 8 October 2026, carries the row: eToro NY LLC, Virtual Currency and Money Transmitter Licenses, date granted 2023-02. It covers eToro NY LLC only, not eToro (Europe) Limited. |
| Financial Conduct Authority (FCA), United Kingdom | authorisation | no | Claimed for eToro (UK) Ltd. on eToro's terms page. Not confirmed: the FCA register returned a JavaScript error page with no firm data on two attempts. |
| Australian Securities and Investments Commission (ASIC), Australian financial services licence | authorisation | no | Claimed for eToro AUS Capital Limited on eToro's terms page. An AFSL covers financial products such as CFDs and securities, not spot crypto as such. Not confirmed: no ASIC register search was run for this entry. |
| Financial Services Authority Seychelles (FSAS) | authorisation | no | Claimed for eToro (Seychelles) Ltd. on eToro's terms page. Not confirmed: no FSAS register was loaded. |
| Abu Dhabi Global Market Financial Services Regulatory Authority (ADGM FSRA) | authorisation | no | Claimed for eToro (ME) Limited on eToro's terms page. Not confirmed: no FSRA register was loaded. |
| European Securities and Markets Authority (MiCA register of non-compliant entities) | adverse listing | not listed | Negative check. The official ESMA register of non-compliant entities providing crypto-asset services was retrieved on 8 October 2026 (173 data rows, ending with a complete row) and searched. The string eToro does not appear in it. |
6. Proof of reserves
No eToro-hosted proof of reserves page could be loaded. No proof of reserves was located on etoro.com, and the EU terms link none. Recorded as no data rather than not published.
Nothing is recorded here as a result. The field is No data rather than no, because a page that would not load is not the same as a disclosure that does not exist, and this register does not publish the two as though they were.
7. Custody, segregation and insolvency
What the binding document says about where your coins sit and what happens to them if the exchange fails, quoted rather than characterised.
we will only have an unsecured claim against the party on behalf of you and our other clients.etoro.com
8. Freezing your account
2 clauses, quoted in the order they appear in the document. Read the last one first: it is the ground that swallows the others.
26.5 We will take reasonable steps to provide you with appropriate notice if we freeze, block, or terminate our Services and/or your etoro account. However, there might be times when we are required to freeze, block, or terminate our Services and/or your etoro account without telling you in advance. We will do this if we reasonably believe that there is a security or regulatory risk, you have breached the Agreement, there is an Exceptional Event, we are required to do so by Applicable Law or by a regulator, and/or there is an application, order, resolution or another announcement in relation to a winding up/bankruptcy in which you are involved.etoro.com
(a) we decide to stop providing you with our Services;etoro.com
9. Suspending withdrawals
Our processing may be delayed or declined if required under Applicable Law, including if we have an AML concern. We may, or may not be able to, disclose to you the reasons for such delay or rejection.etoro.com
10. Sending funds to a casino from eToro
Not verified. The document that would contain eToro's gambling clause could not be retrieved.
The retrieved text of the EU Terms and Conditions contains no gambling, lottery, casino, betting or wager clause; "gaming" appears only in the market-abuse phrase "gaming the system". The text ended inside Schedule A, so the cryptoasset schedule and the wallet terms were not searched. Recorded as not verified.
11. Which networks eToro withdraws USDT on
No dataThe network list could not be confirmed. See the note below.
The eToro crypto wallet page names BTC, ETH, XRP and USDC as examples of supported assets but names no networks and does not mention USDT. The help centre article listing supported wallet assets returned a JavaScript error page. No chain is counted. Source. Which DEXes operate on each of those chains is in the DEX register.
12. Amendment, liquidation, arbitration and governing law
The clauses that decide what the contract can become, what can be done to an open position, and where a dispute would be heard.
33.2 We may make changes to these Terms and Conditions from time to time. For example, we might need to add new terms, or amend existing terms to reflect changes in: (a) our business, Services or products or how we provide them; (b) the systems we use; and/or (c) Applicable Law or regulation or industry recommendations. We may also make changes for reasons not set out here.etoro.com
13. Public record
Matters of public record, taken from primary sources and stated with them. They are not scored, because a historical event is not a measurement of how the exchange behaves today, and leaving them out while citing the sources would be worse.
The US Securities and Exchange Commission announced that "eToro USA LLC has agreed to pay $1.5 million to settle charges that it operated an unregistered broker and unregistered clearing agency in connection with its trading platform that facilitated buying and selling certain crypto assets as securities." The release, headed "eToro Reaches Settlement with SEC and Will Cease Trading Activity in Nearly All Crypto Assets", states that without admitting or denying the findings eToro agreed to a cease-and-desist order and, within 187 days, to liquidate crypto assets offered and sold as securities that it is unable to transfer to its customers and return the proceeds to them.
14. Who should avoid eToro
Anyone outside the European Economic Area who is relying on the authorisation they can see. The confirmed authorisation is held by eToro (Europe) Ltd and covers that company's clients. A user elsewhere is contracting with a different entity under different terms.
